This website is operated by BTTR DYZ (“we”, “us”, “our”). By visiting our site and/or purchasing something from us, you agree to these Terms of Service (“Terms”), including any additional policies referenced here (including our Returns Policy and Privacy Policy).

If you do not agree to these Terms, you must not use our site or Services.

1) About BTTR DYZ and our platform

Our store is hosted on Shopify Inc., which provides the ecommerce platform that enables us to sell products and services to you.

Orders may be fulfilled using third-party partners, including MerchSprint powered by Create Apparel (Australia), depending on the product you purchase.

2) Eligibility and acceptable use

By using the site, you confirm that you are at least the age of majority in your place of residence, or you have permission from a parent or guardian.

You must not use the site or products for:

  • any unlawful purpose

  • violating any intellectual property rights

  • distributing malware, viruses, or harmful code

  • scraping, harvesting data, or interfering with site security

  • abusive, harassing, defamatory, or discriminatory behaviour

We may suspend or refuse service if we believe you have breached these Terms.

3) Our products and made-to-order fulfilment

BTTR DYZ products may be made to order. This means:

  • your item is produced after you place your order

  • dispatch times may include production time before shipping

  • availability of blanks or components may change

We take care to display products as accurately as possible. Colours and appearance can vary depending on your device and screen settings.

4) Orders, pricing and availability

All prices are listed in AUD unless stated otherwise. Prices may change without notice.

We reserve the right to:

  • refuse or cancel any order

  • limit quantities per customer or per household

  • cancel orders that appear to be fraudulent, bulk reseller orders, or otherwise high-risk

If we cancel an order after payment, we will refund the amount paid using the original payment method.

5) Billing and customer information

You agree to provide current, complete, and accurate purchase and account information for all orders. This includes your email address, shipping address, and payment details.

You are responsible for ensuring your shipping address is correct at checkout. If an order is sent to the address you provided, and it is incorrect, you may be responsible for additional costs to reship (if reshipping is possible).

6) Shipping, delivery and risk

Estimated shipping and delivery timeframes provided on the site are estimates only and can be impacted by production schedules, peak periods, and courier delays.

Once your order is dispatched, delivery is handled by third-party carriers. If a parcel is delayed, lost, or damaged in transit, we will assist you to lodge an enquiry with the carrier and provide required information.

Nothing in these Terms limits your rights under Australian Consumer Law.

7) Returns and refunds

Returns, replacements, and refunds are handled according to our Returns Policy, which forms part of these Terms. Please refer to the Returns Policy linked in the footer of our website.

Where a product has a major fault, you may be entitled to a refund, replacement, or repair under Australian Consumer Law.

8) Promotions, discount codes, and drops

Discount codes:

  • may have expiry dates

  • may be limited to specific products or collections

  • cannot usually be combined unless stated

  • may be cancelled if misused or shared in ways that breach these Terms

For limited drops, products may sell out quickly. Adding an item to cart does not reserve it.

9) Third-party tools and services

We may provide access to third-party tools or services (including apps, analytics, and marketing tools) that we do not control. These are provided “as is” and “as available”. Your use of third-party services may be subject to their own terms and policies.

10) User-generated content and submissions

If you submit content such as reviews, comments, images, or messages:

  • you confirm you have the right to submit it

  • you grant us permission to use, reproduce, and display it in connection with our business (including marketing), unless you request removal and removal is reasonably possible

  • you agree your content will not be unlawful, defamatory, obscene, or infringe another person’s rights

We may remove content at our discretion.

11) Intellectual property

All content on this site, including logos, artwork, product names, graphics, images, and written content, is owned by or licensed to BTTR DYZ and protected by intellectual property laws.

You must not copy, reproduce, or use our content for commercial purposes without written permission.

12) Accuracy of information

We aim to keep information on the site accurate, but sometimes there may be errors related to pricing, product details, promotions, shipping rates, or availability.

We reserve the right to correct errors and update information at any time, including after an order has been placed. If a change affects your order materially, we will contact you.

13) Disclaimer and limitation of liability

To the maximum extent permitted by law, BTTR DYZ:

  • does not guarantee the site will be uninterrupted, secure, or error-free

  • is not responsible for losses caused by events outside our control (including courier delays, platform outages, or payment provider outages)

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under Australian Consumer Law or other applicable laws.

14) Indemnity

You agree to indemnify and hold BTTR DYZ harmless from any claim or demand (including reasonable legal fees) arising from your breach of these Terms or misuse of the Services.

15) Termination

These Terms remain in effect unless terminated by you or us. We may suspend or terminate access to the site if we reasonably believe you have breached these Terms.

Any obligations incurred before termination survive termination.

16) Governing law

These Terms are governed by the laws of Australia. Any disputes will be handled under Australian law.
